CheckMole — Terms of Service

1. Agreement to these Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("you", "user") and:

By downloading, installing, or using the CheckMole mobile application or any related web surfaces (collectively, the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. What CheckMole is — and what it is not
CheckMole is an educational and informational tool that helps you self-monitor skin moles over time using the ABCDE method (Asymmetry, Border, Color, Diameter, Evolution). It analyses photographs you capture using an AI model, records history, and provides reminders.
2.1 Medical disclaimer (important)
CheckMole is NOT a medical device within the meaning of EU Regulation 2017/745 (MDR), the U.S. Federal Food, Drug, and Cosmetic Act, or any equivalent legislation. CheckMole:
- Does not provide a medical diagnosis
- Does not detect or diagnose cancer, melanoma, or any other disease
- Is not a substitute for consultation with a qualified medical professional
- Must not be relied upon as the sole basis for any medical decision
AI-generated output (ABCDE labels, risk percentages, textual summaries, change analyses) is a heuristic estimation provided for informational purposes only. If you have any concerns about your skin, consult a licensed dermatologist or equivalent healthcare provider.
Emergencies: If you suspect a serious skin condition, do not rely on the Service — contact a doctor or emergency services immediately.
2.2 No doctor-patient relationship
Use of the Service does not create a doctor-patient or medical professional-client relationship between you and the Provider or any of its employees, contractors, or sub-processors.
3. Eligibility
You must be at least 13 years old to use the Service. In jurisdictions where the minimum age for online services is higher (e.g., 16 in some EEA countries under GDPR-K), you must meet the local age requirement.
By using the Service, you represent that:
- You meet the minimum age requirement
- You have the legal capacity to enter into these Terms
- You are not barred from using the Service under any applicable law
If you are using the Service on behalf of another person, you represent that you are authorized to do so.
4. Your account
Some features require you to create an account (email + password). You agree to:
- Provide accurate, current, and complete information
- Keep your password confidential and not share it
- Notify us promptly of any unauthorized access at support@checkmole.com
- Be responsible for all activity under your account
You may use most of the Service without an account (as a local-only user). Cloud sync, history backup, and cross-device features require an account.
5. Your content and license
You retain all rights to the photographs, notes, and other content you submit ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Process User Content through our AI pipeline to generate analysis
- Store User Content on our infrastructure solely to provide the Service to you
- Transmit User Content to our sub-processors (see Privacy Policy, Section 6)
This license terminates when you delete the content or your account, except for anonymized aggregates we may retain for service improvement, and for data we are legally required to keep.
You represent that you have all necessary rights to the User Content you submit and that it does not infringe any third-party rights.
6. Acceptable use
You agree NOT to:
- Use the Service for any purpose other than personal, non-commercial self-monitoring
- Upload images that are not of your own skin (or of a minor under your legal guardianship, with their or their guardian's understanding)
- Upload illegal, infringing, or harmful content
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Interfere with or disrupt the Service (e.g., automated scraping, DoS, attempted SQL injection)
- Bypass paywalls, free-tier limits, or authentication mechanisms
- Use the Service to make medical diagnostic claims to others
- Resell, sublicense, or redistribute access to the Service
We may suspend or terminate your access if we believe you have violated these rules.
7. Free tier and fair use
The Service offers a free tier with the following limitations:
- 2 counted scans on your primary mole track
- Between the first and second scan, a 7-day retention window must pass
- A consecutive cap on "unusable" scans (e.g., dark frames) to prevent abuse of the AI quota
- Limited history depth on the free tier
These limits are enforced to maintain availability and bear the cost of AI analysis for all users. Attempts to bypass them are prohibited (Section 6).
8. Subscriptions and billing
8.1 How subscriptions work
CheckMole offers paid subscription plans ("Pro") with additional features (unlimited scans, full history, advanced comparisons, PDF reports, UV features).
Subscriptions are sold through Apple App Store on iOS and Google Play Billing on Android. Payment is processed by Apple or Google, not by us. Applicable VAT or sales tax is collected by the store.
Current plans (subject to change):
- Weekly — recurring weekly subscription
- Annual — recurring yearly subscription (best value)
Actual prices are displayed in the app at checkout and may vary by country.
8.2 Trial
A free trial may be offered on certain plans. At the end of the trial, the subscription auto-renews at the regular price unless canceled at least 24 hours before the trial ends, per Apple/Google policy.
8.3 Auto-renewal
Subscriptions automatically renew at the end of each billing period unless you cancel. You can manage and cancel your subscription in:
- iOS: Settings → [your Apple ID] → Subscriptions
- Android: Google Play Store → Subscriptions
Cancellation takes effect at the end of the current billing period; you keep Pro access until then.
8.4 Refunds
Refunds are handled by Apple and Google under their respective policies:
We do not process refunds directly.
8.5 EU consumer right of withdrawal (important)
Under Polish and EU consumer law, consumers normally have a 14-day right to withdraw from a distance contract for digital content. However, by starting your subscription and accessing Pro features, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the digital content has been supplied and you have used it.
If you do not want to waive this right, do not start Pro access during the 14-day period; you may request a refund per Apple/Google policy instead.
8.6 Price changes
We may change subscription prices. For existing subscribers, changes take effect at the next renewal after you are notified (via app or email) at least 30 days in advance.
9. Intellectual property
The Service, including the CheckMole name and logo, the app, its source code (except open-source components under their respective licenses), its visual design, its AI prompts, and all associated content (the "Provider IP") is owned by the Provider or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial self-monitoring in accordance with these Terms.
Nothing in these Terms transfers ownership of any Provider IP to you.
10. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, OR SECURE
- ANY WARRANTY OF MEDICAL ACCURACY OR CLINICAL UTILITY
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply only to the extent permitted.
Nothing in these Terms limits your statutory consumer rights under applicable mandatory law (e.g., Polish Consumer Rights Act, EU consumer directives).
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Our total aggregate liability for any claim arising from or relating to these Terms or the Service is limited to the amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim, or €50, whichever is greater.
- We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or health-related damages arising from any reliance on AI output that is inconsistent with Section 2.1 (Medical Disclaimer).
- We are not liable for any decision you make based on AI analysis produced by the Service. You are solely responsible for your medical choices and for seeking qualified professional advice.
Nothing in this section limits liability that cannot be limited under applicable mandatory law, including liability for death or personal injury caused by gross negligence or intentional misconduct (where applicable), and statutory consumer rights.
12. Indemnification
You agree to indemnify and hold harmless the Provider and her agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of:
- Your breach of these Terms
- Your misuse of the Service
- Your User Content
- Your violation of any third-party right
- Your violation of any applicable law
This indemnity does not apply to the extent a claim arises from our own wrongful acts.
13. Termination
You may stop using the Service at any time and delete your account in-app or by emailing support@checkmole.com.
We may suspend or terminate your access to the Service if:
- You materially breach these Terms
- Required by law
- The Service is discontinued
Upon termination, your subscription (if any) is governed by Apple/Google billing terms. Sections 2.1, 5 (your retained ownership), 9, 10, 11, 12, 15, 16, and 17 survive termination.
14. Changes to these Terms
We may update these Terms to reflect changes in the Service, applicable law, or business practice. When we make material changes, we will:
- Update the "Last updated" date at the top
- Notify you in-app or by email (for signed-in users) at least 14 days in advance where feasible
Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree, stop using the Service and cancel any active subscription.
15. Apple App Store — additional terms
These provisions apply if you downloaded the Service from the Apple App Store. You acknowledge:
- These Terms are concluded between you and the Provider only, not with Apple. The Provider (not Apple) is solely responsible for the Service and its content.
- Apple has no obligation to provide maintenance or support for the Service.
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple; Apple will refund the purchase price and have no other warranty obligation. Any other claims, losses, liabilities, damages, costs, or expenses are the Provider's sole responsibility to the extent set out in these Terms.
- The Provider is responsible for addressing any product claims, including product liability, consumer protection, or intellectual property claims.
- You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and (ii) you are not listed on any U.S. Government prohibited-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
16. Governing law and dispute resolution
16.1 Governing law
These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-laws principles. For consumers residing in the EEA, this does not deprive you of the protection of mandatory consumer protection rules of your country of habitual residence.
16.2 Informal resolution first
Before filing any formal proceedings, please contact us at support@checkmole.com with a description of the issue. We will try to resolve the dispute informally within 30 days.
16.3 Courts
If informal resolution fails, disputes will be resolved by the competent courts of Warsaw, Poland. For consumers, this does not override your right to bring proceedings before the courts of your country of habitual residence if EU consumer law entitles you to do so.
16.4 EU Online Dispute Resolution
The European Commission provides an online platform for dispute resolution: ec.europa.eu/consumers/odr. We are not obligated to participate but may choose to do so.
17. Miscellaneous
- Severability — If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
- No waiver — Our failure to enforce any provision is not a waiver of that provision.
- Entire agreement — These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Assignment — You may not assign your rights under these Terms. We may assign our rights in connection with a merger, acquisition, or reorganization.
